These Terms of Service ("Terms") govern your use of Memory Boom ("Service"), operated by LUKA MATIĆ PR RAČUNARSKO PROGRAMIRANJE MAHADEVA TECH RUMA, a sole proprietor registered in the Republic of Serbia, with registered address at Veljka Dugoševića 134/33, 22400 Ruma, Serbia, PIB: 113651324 ("we", "us", or "our").
These Terms apply to hosts, who create an account and events, and to guests, who open an event's page through its QR code or link to view its gallery or add photos and videos to it. By creating an account, or by uploading to or viewing an event's gallery, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
Our Privacy Policy, which explains how we handle personal data, and our Refund Policy are incorporated into these Terms by reference. Please review them carefully.
Memory Boom lets hosts create a gallery for an event, such as a wedding, birthday or party, and share it with their guests through a QR code or link. Guests open the event's page in their browser, without an account or an app, to add photos and videos and to see everyone else's in one shared gallery. Hosts can download everything afterwards.
Each event is paid for once, and its gallery stays open for a gallery period of 12 months. When that period ends, the event's photos and videos are deleted (section 11).
To create events, you must create an account, and you must be at least 18 years old, or the age of majority where you live. You agree that any information you provide is accurate. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
Guests don't need an account. You can add a display name, which is shown with your uploads to everyone who can open the event's gallery. Without one, your uploads are shown as "Guest".
Your browser keeps a random identifier that lets it recognise the photos and videos you uploaded from it, so that you can find and delete them. If you clear your browser's data or switch to another device, you can no longer delete them yourself: ask the host, or contact us (section 9).
If you are under 16, ask a parent or guardian before you upload anything.
A new event is a draft, closed to guests, until you pay for it. You pay once per event, by choosing a plan, which sets the event's storage limit. Plans and prices are on our pricing page. Nothing renews automatically.
The gallery period starts on the event's date, or on the day you pay if that is later, and ends 12 months later, at midnight in the event's time zone. Guests can add photos and videos from the start of the event's date until the gallery period ends. Check the event's date and time zone before you pay: they can't be changed afterwards.
Photos can be up to 50 MB and videos up to 2 GB each, as JPEG, PNG or WebP photos and MP4, MOV or WebM videos. Once an event's storage is full, guests can't add more.
While an event is active, you can upgrade it to a plan with more storage by paying the price difference. The gallery period stays the same.
Prices are in US dollars. Payment processing is handled by Dodo Payments Inc. ("Dodo Payments"), who acts as the Merchant of Record for all transactions. Dodo Payments handles billing, tax collection, invoicing, payment processing and local currencies on our behalf. By paying for an event, you also agree to Dodo Payments' Buyer Terms. You can see your payments and invoices from the Billing page inside the app.

Anyone with an event's link or QR code can open its gallery, see each photo and video with its uploader's display name and upload time, and download the original files. Event pages are hidden from search engines and their links are hard to guess, but we can't control who a link is passed on to, so hosts should share it only with people they want to see the gallery.
Photos and videos are stored exactly as uploaded, including any information the device saved in the file, such as when and, if the device recorded it, where it was taken.
Hosts can pause uploads, hide any photo or video from guests, and delete any photo or video in their event's gallery. Guests can delete the ones they uploaded (section 4).
You keep the rights to the photos and videos you upload. By uploading them to an event, you allow the host, and everyone who can open the event's gallery, to view and download them, and the host to keep the copies they download. What the host and guests do with downloaded copies is up to them and outside our control.
You grant us a limited license to store, copy, display and deliver your uploads solely for the purpose of providing the Service. It ends when they are deleted.
When you upload a photo or video, you confirm that you have the right to share it, including any music, artwork or other third-party material it contains, and that the people in it wouldn't object to it being shared with the event's guests. Take particular care with photos and videos of children. Uploading material you don't have the rights to can cause problems with the rights holders, and that responsibility sits with you, not us.
The Service itself, including its software, design, guest page designs, trademarks, and documentation, is the intellectual property of LUKA MATIĆ PR RAČUNARSKO PROGRAMIRANJE MAHADEVA TECH RUMA and is protected by applicable intellectual property laws.

Any photo or video in a gallery can be reported: its report option opens an email to us at tech.mahadeva@gmail.com with a link to it. You can also write to us directly.
We take copyright seriously. If you believe that a photo or video on Memory Boom uses your copyrighted work without permission, please email us with "Copyright Notice" in the subject line and include:
We'll review every report, remove content that breaks these Terms or the law, and let the event's host know. If the host or the uploader thinks it was removed by mistake, they can reply at the same address explaining why. We may suspend events or accounts that are repeatedly used to share content in breach of these Terms.
To the extent permitted by applicable law, if someone brings a claim against us because of content you uploaded or an event you host — for example, a copyright, trademark, or privacy claim — you agree to cover our reasonable costs of dealing with it, including legal fees. This only applies to claims caused by your content or your use of the Service, not to claims arising from the Service itself.
Memory Boom is not long-term storage. Within 48 hours after an event's gallery period ends, we delete all of its photos and videos, keeping only the event's details and payment record. We email the host 7 days and 1 day before the gallery period ends, as a reminder to download everything they want to keep.
When a host deletes an event, its page stops working at once, and its photos and videos are deleted within 24 hours. Deleting a paid event does not refund it.
Hosts can delete their account at any time from the Account page inside the app, or by contacting us at tech.mahadeva@gmail.com. Deleting an account also deletes all of its events and their photos and videos.
We don't keep backups of photos and videos, so once deleted they can't be recovered.
If an event's payment is refunded in full, or disputed with a bank or card provider (a "chargeback"), we suspend the event: guests can no longer open it and the host can no longer download from it. Its photos and videos are kept until its gallery period ends, and then deleted as usual. We email the host when an event is suspended.
If a dispute is withdrawn or decided in our favour, the event reopens. After a full refund, or a dispute that is decided against us or that we accept, the event stays suspended, and we don't accept new payments from the same email address. While a dispute is open, we don't accept new payments from that account. See our Refund Policy for details.
We may remove content, or suspend or close events and accounts, that violate these Terms or that we reasonably believe harm the Service, its users or others.
We strive to maintain high availability of the Service, but do not guarantee uninterrupted or error-free operation. We may perform maintenance, updates, or modifications that temporarily affect availability. We are not liable for any downtime or service interruptions.
We shall not be liable for any failure or delay in providing the Service caused by circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, civil unrest, government actions, power or internet outages, third-party infrastructure failures, or the unavailability or outage of hosting, payment or other upstream services that the Service depends upon. In such events, we will make reasonable efforts to restore the Service as soon as practicable.
To the maximum extent permitted by applicable law, LUKA MATIĆ PR RAČUNARSKO PROGRAMIRANJE MAHADEVA TECH RUMA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues or data, whether incurred directly or indirectly, arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for intent or gross negligence.
We reserve the right to modify these Terms at any time. We will notify registered users of material changes via email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the Republic of Serbia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts of the Republic of Serbia. If you are a consumer, this does not take away the protection of the mandatory laws of the country where you live.
